The PPPR Act – Its Purpose, Procedure, and Pleasant Results.

Imagine suddenly losing the ability to make decisions about your own life - where you live, how your money’s handled, or who takes cares for you. Not too bad for your family if you have Enduring Powers of Attorney in place, right?

…Well, what happens if you don’t?

It’s a daunting thought, but one the Protection of Personal and Property Rights Act 1988 (or PPPR Act, for short) was created to address.

This quietly powerful statute gives a voice to individuals who have lost the ability to speak or act for themselves, making sure their rights and best interests are protected. Examples where the PPPR Act may step in is when someone is living with mental illness, intellectual disabilities, or a brain injury. It’s the legal safety net you hope you never need, but you’ll be glad it exists.

The PPPR allows the Court to grant you a Property Administrator to look after your financials and physical property, and a Welfare Guardian to make decisions regarding your personal care such as medical treatment when you are unable to.

You may be thinking, well, easy! Why would I bother setting up an EPOA if the Court can do it for me?

The blunt answer to that, dear reader, is cost.

The cost of applying to the court for a PPPR order far exceeds anything required to set up your attorneys. Besides monetary costs, the process of going through the courts is mentally taxing on your loved ones who will already potentially be struggling.
